General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all business relationships, orders, offers and contracts concluded via the website www.herzschniderin.ch between the operator of the website (hereinafter referred to as "Provider") and its customers (hereinafter referred to as "Customers").

By accessing the website and using the offered products and services, the customer agrees to these Terms and Conditions. Any differing, conflicting, or supplementary terms and conditions of the customer shall not become part of the contract unless the provider expressly agrees to their validity in writing.

The provider reserves the right to amend these terms and conditions at any time. The version published at the time of the order or commission applies.

The provider operates the website www.herzschniderin.ch and is the contractual partner for all contracts concluded via this website as well as for all resulting services and deliveries.

3. Subject of the contract

The subject of this contract is the products and services offered by the provider via the website www.herzschniderin.ch . These include, in particular:

  • individually created and handcrafted textiles,

  • Sewing work and textile production according to customer specifications,

  • Courses and workshops in the field of sewing and textile design,

  • as well as other related creative services.

The essential characteristics of the products and services can be found in the respective descriptions on the website, in offers, course announcements or in individual agreements between the provider and the customer.

Images on the website are for illustrative purposes only. As some items are handmade or custom-made, slight variations in color, material, pattern, or design may occur and do not constitute a defect.

For individually agreed-upon projects, the specific scope of services is determined by the respective order confirmation or quotation. Changes to the scope of services are only possible after prior agreement and may result in additional costs.

The provider reserves the right to adjust its services at any time, to cancel or postpone courses or workshops if there are valid reasons; in this case, the communicated replacement or refund regulations apply.

4. Conclusion of the contract

The presentation of products, services, courses and workshops on the website www.herzschniderin.ch does not constitute a legally binding offer, but rather a non-binding invitation to inquire or book.

A contract is concluded as soon as the customer submits an order, booking or request via the contact form, by email, by telephone or, if applicable, via an online ordering system, and the provider expressly confirms this order or booking (e.g. by email, offer or order confirmation) or begins to perform the service.

For custom-made textiles and sewing work, the contract is usually concluded after prior agreement on the details and acceptance of an offer by the customer.

For courses and workshops, the contract is concluded upon registration by the customer and subsequent confirmation by the provider. The number of participants may be limited; registrations will be considered in the order they are received.

Technical steps leading to the conclusion of the contract

If registration or ordering is done via the website, the ordering or booking process usually includes the following steps:

  1. Selection of desired products, services, courses or workshops, or completion of the inquiry form.

  2. Enter the required contact and order details,

  3. Verification of the entered information,

  4. Submitting the request, order or registration via the website,

  5. Receipt of an acknowledgement of receipt (not yet acceptance of the contract),

  6. The contract is concluded either through express confirmation by the provider or through the commencement of the service provision.

Customers are obliged to provide complete and correct information when placing an order or registering.

5. Registration and cancellation for courses and workshops

Registration

Registration for courses and workshops takes place via the website, email, telephone, or another registration method provided by the organizer. By registering, the customer submits a binding offer to conclude a contract.

The contract is concluded upon confirmation of registration by the provider. The number of participants per course or workshop is limited. Registrations are considered in the order they are received.

The provider reserves the right to cancel or postpone courses or workshops due to insufficient enrollment, organizational reasons, or force majeure. In this case, payments already made will be fully refunded or—at the customer's option—credited towards a rescheduled date. No further claims exist.

Cancellation / Dismissal by the Customer

Cancellation of a booked course or workshop is free of charge up to 14 days before the course begins. Cancellation must be made in writing via email .

For cancellations after this deadline or in case of no-show, the full course fee will be charged unless the place can be filled. A substitute participant may be provided after prior agreement with the course provider.

For individually booked single courses or special workshops, the cancellation conditions agreed in the offer or order confirmation apply.

6. Prices and Payment Terms

Payment is 100% due on site upon collection or, in the case of shipping, against prepayment.

For booked events, payment by invoice is possible. The payment terms (due date, payment deadline, etc.) will be agreed upon individually with the customer in advance.

Unless otherwise agreed, invoices are payable within 10 days of the invoice date without deduction. In case of late payment, we reserve the right to charge reminder fees and default interest in accordance with statutory regulations.

9. Returns

Returns

Returns are possible within 14 days of receiving the goods, provided the following conditions are met:

  • The goods are unused, undamaged and in perfect condition.

  • Returns must be announced in advance via message or email (immediate response upon receipt that a return is desired).

  • The goods must be returned properly packaged.

Replacement or refund

After receiving and inspecting the returned goods, an agreement will be made as to whether:

  • a replacement item will be sent or

  • A refund of the purchase price will be issued.

The decision is made based on the condition of the returned goods.

Return shipping costs

The customer is responsible for return shipping costs. Returns sent collect cannot be accepted.

10. Warranty and complaints regarding textiles

The supplier produces all textiles individually and by hand. Minor variations in color, pattern, size, or material compared to images or descriptions do not constitute a defect.

Customers are obligated to inspect delivered products immediately upon receipt. Obvious defects or transport damage must be reported in writing by email or letter within 7 days of receipt.

If a justified defect exists, the supplier is entitled, at its own discretion, to repair, replace, or reduce the price. Further claims, in particular for damages, exist only within the framework of statutory provisions and insofar as they are not based on intentional or grossly negligent conduct on the part of the supplier.

Non-refundable deviations include, in particular: minor color differences due to different screen displays or fabric batches, slight deviations in size, shape or structure due to handcrafted production, normal wear and tear during intended use.

Complaints regarding custom-made or personalized products can only be accepted if the defect is clearly due to manufacturing errors.

11. Liability and insurance for courses/workshops

Participation in courses and workshops is at the participants' own risk. The provider accepts no liability for damages or injuries arising in connection with participation in courses, workshops, or during the use of the provided materials, unless these are due to intentional or grossly negligent conduct on the part of the provider.

Participants are responsible for obtaining adequate insurance coverage for accidents, illness, or other risks. It is recommended that participants use their own protective clothing or materials, especially for manual tasks, after consulting with the provider.

The provider is not liable for the loss of personal belongings during the courses or workshops.

12. Usage rights / Copyright

All content on the website www.herzschniderin.ch, including texts, images, graphics, designs, course materials, patterns and other creative works, is protected by copyright and is the property of the provider or the respective rights holders.

By purchasing products or participating in courses/workshops, customers do not acquire any further rights of use to the designs, materials or content, unless expressly agreed otherwise in writing.

The use, reproduction, distribution, publication or other exploitation of the content without the express consent of the provider is prohibited and may be prosecuted.

For custom-made products or textiles manufactured specifically according to customer specifications, the copyrights and intellectual property rights remain with the supplier, unless otherwise agreed. Customers may use the products for private purposes.

Any commercial use, reproduction or distribution requires the written consent of the provider.

13. Data protection

12. Retention of title

The products supplied by the provider remain the property of the provider until full payment has been received.

As long as the retention of title exists, the customer is obliged to handle the products carefully and protect them from damage, loss or theft.

Resale, pledging or other transfer of ownership as security of the products is not permitted without the express consent of the supplier.

Ownership of the products transfers to the customer upon full payment.

12. Final Provisions

Severability clause

Should individual provisions of these Terms and Conditions be wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.

Changes to the Terms and Conditions

The provider reserves the right to amend these terms and conditions at any time. The version published at the time of order, booking, or service provision shall apply.

Applicable law

Swiss law applies exclusively.

Jurisdiction

The place of jurisdiction for all disputes arising from or in connection with these terms and conditions is, to the extent legally permissible, the registered office of the provider in Switzerland.

Contract language

The contract language is German.
